Services. Upon enrolling in our Services, our team will create a Customer Account using the name, address, email address, and payment information you provide. Once your account has been created, we will send you access details for your selected Program.
Services will be delivered through email, Skool, or any other method mutually agreed upon by both parties in advance.
Payments. You agree that upon entering this Agreement you agree to pay a one-time, non-refundable fee as specified at the point of sale. This fee grants you access to the Program and its related materials, as outlined in the Program description.
Payment must be made in full at the time of purchase. Bye Bye Panic accepts payments via secure electronic methods, including but not limited to Stripe and PayPal.
In the event of a failed or disputed payment, Bye Bye Panic reserves the right to suspend or terminate your access to the Program until the outstanding amount is resolved. You agree to be responsible for any costs incurred in the collection of unpaid fees, including reasonable legal fees and expenses, if applicable.
Financial Commitment. In joining the Bye Bye Panic Program, You are committing to the full financial investment. This means that you agree that payments are not refundable for any reason and are due regardless of your level of participation. The client agrees to the company’s no refund policy.
Termination, Cancellation and Refunds. All of the materials that will be provided to you have been created from the expertise and experience of your host and all facilitators. All these materials require extensive investment on their part. As such, no refunds or money-back guarantees will be issued.
DUE TO THE NATURE OF THE MEMBERSHIP PROGRAM, THERE ARE NO REFUNDS IN ANY CIRCUMSTANCE.
The client agrees to the membership plan that was provided to them at the point of sale and the client recognizes this is a final, non-negotiable offer.
The client agrees to handle any payment grievances and disputes despite being aware of the no refund or cancellation policy by contacting support@byebyepanic.com. The client agrees not to contact their banking institution to report fraudulent charges or file a chargeback with their credit card company.
Representations and Warranties. In signing this agreement, you represent and warrant that you:
Confidentiality. Any personal information you provide, will be kept in the strictest professional confidentiality. Please note that the law does not protect the confidential communication between a Bye Bye Panic and Member as privileged, as Bye Bye Panic is not a health care or legal professional. Bye Bye Panic will only have to suspend confidentiality in the following cases:
Protection of Materials. As part of the Program, Bye Bye Panic will be providing you with materials, outlines, concepts, and other relevant information (“Materials”). By signing this Agreement, you confirm that you will not use, reuse, replicate, or imitate the Program or any Materials for any financial gain, or otherwise distribute, or remarket to any third parties, it may be subject to legal proceedings. You also agree not to create separate fringe groups or message individuals privately. All my questions go through the community group or emailed privately at support@byebyepanic.com.
Intellectual Property Rights. Bye Bye Panic owns, solely and exclusively, all right, title, and interest in and to all “Intellectual Property” which includes, but is not limited to, the Program, Services, Materials, and any outlines, tools, techniques, concepts, or any other information uniquely created by Bye Bye Panic. Bye Bye Panic grants to Member a limited, non-exclusive, non-transferable, non-sublicensable revocable license to use all or any of the Intellectual Property granted to Member as part of the Program for private personal use, and for the purpose for which the Intellectual property were provided for only.
You understand that all Materials are protected by copyright, trade secret, or other proprietary laws. You also agree not to use any audio or video recording devices during the Program. You understand that if you are caught recording sessions, phone calls, you will be terminated, forfeit any payments made, and will be permanently banned from all current and future Programs and Services.
Non-Solicitation Clause:
In consideration of the mutual promises contained herein, the parties agree as follows:
1. Non-Solicitation of Members:
During the term of this Agreement following the termination or expiration of the Member's participation in the program community, the Member agrees not to directly or indirectly solicit, induce, or attempt to influence any other member of the program community (hereinafter referred to as "Community Members") to engage in the following activities:
a. Consulting or Services:
The Member shall not, for their own personal gain or the gain of a third party, solicit or offer consulting or professional services to Community Members, whether directly or indirectly.
b. Selling or Marketing:
The Member shall refrain from engaging in any form of direct or indirect selling or marketing activities targeting Community Members, including but not limited to the promotion of products, services, or opportunities.
c. Phishing or Deceptive Practices:
The Member shall not employ phishing, deceptive, or misleading practices to entice Community Members into divulging sensitive information or participating in activities contrary to the best interests of the program community.
d. Coaching Programs:
The Member shall not encourage, entice, or induce Community Members to join any coaching program, whether owned or affiliated with the Member, during the term of this Agreement and the specified post-termination period.
2. Confidentiality:
The Member further acknowledges and agrees that any information, including but not limited to proprietary methodologies, trade secrets, or business practices, obtained during their participation in the program community is strictly confidential and may not be used for personal gain or disclosed to third parties without the express written consent of the Organization.
3. Consequences of Breach:
In the event of a breach of this non-solicitation clause, the Organization reserves the right to pursue legal remedies, including injunctive relief and monetary damages, to protect its interests and those of the program community. In addition, the company will remove your access and will be banned from the entire program and community.
